Description
As an adjunct to the “Learn from Litigation Results and Bankruptcies” session, this session will focus on an actual energy company Chapter 11 bankruptcy case and certain key contract and legal issues that arose. Michael Etkin and D. Brent Wells will discuss how these issues unfolded and were resolved in the case. The speakers will navigate through the Chapter 11 from the inception and will discuss issues impacting contract counterparties and creditors, including topics such as post-petition financing, critical vendor status, enforceability of safe harbor and setoff provisions and assumption or rejection of executory contracts.
